The same rules, on both sides

The convention of the particulier employeur and the employé de maison (IDCC 3239, in force since 1 January 2022) applies to the household employer and to the employee alike. That is why every page in this section states the rule for both: most disputes at home are not disagreements about the rule, they are two people holding different numbers.

The relationship, moment by moment

It starts with a written contract

Before the first hour, the contract fixes what is owed: the job, the hours, the hourly rate and the trial period. The pay grid has 12 levels; an assistant maternel has one contract per child received.

Every month, one declaration

The hours actually worked go to CESU or Pajemploi in a window that opens on the 25th and closes on the 5th of the next month. The service computes the net, the contributions and the payslip — you never enter a net figure.

Leave accrues while it runs

2.5 working days a month, over a reference year that runs 1 June to 31 May. It matters twice: during the relationship, and again at the end, when what was never taken is paid.

And it ends on a procedure

Whichever side ends it, the same figures apply: notice, dates, indemnity, and the documents URSSAF and France Travail expect. The calculator is free, for both parties.

One month, agreed by both

The employee knows the hours worked; the employer knows what was declared. When those two figures differ, the argument arrives at the end of the contract — because the indemnity is computed on the gross salaries actually paid. A shared month removes that: one party records the hours, the other confirms them, and any difference surfaces before the declaration rather than after the payslip. Recording, confirming and the reminders before the deadline are free for both parties.

Q.What is a particulier employeur?
Anyone who employs someone at their own home for a private need — a cleaner, a carer, home help, a garde d’enfants — or who employs an assistant maternel agréé to look after a child at the assistant’s home. You are the employer: there is a written contract, a monthly declaration, paid leave, and an end-of-contract procedure. The collective agreement is the CCN of the particulier employeur and the employé de maison, IDCC 3239, in force since 1 January 2022.
Q.What does the relationship involve, month after month?
One act repeats: the hours actually worked are declared to URSSAF — CESU for a salarié du particulier employeur, Pajemploi for childcare — in a window that opens on the 25th of the month and closes on the 5th of the next. The service computes the net, the contributions and the payslip from what you declare. Paid leave accrues at 2.5 working days a month over a reference year running 1 June to 31 May.

Q.What is free and what is paid?
Recording the relationship, inviting the other party, the hours of every month, the confirmations, the reminders and the end-of-contract calculator are free for both sides. The employer's Home Employment Pack (€29) opens the 13 documents and covers BOTH parties — the invited employee generates their own from the same pack and pays nothing. The Employee pack (€9) exists for one case only: an employee who ends the relationship themselves.
Q.Is an assistant maternel different?
On several points, yes. The child is received at the assistant’s home, there is one written contract per child received (CCN art. 90.1), and since 25 January 2026 Pajemploi takes one declaration per child — two siblings means two declarations. Maintenance and meal allowances are paid on top of the salary, carry no contributions, and are excluded from the end-of-contract indemnity. Pages that mix the two regimes get the figures wrong; these keep them apart.

Which procedure applies: for a particulier employeur, the dismissal procedure of the convention collective IDCC 3239 applies instead of the Code du travail procedure (CCN art. 161.1.1: the rules are those of the convention; art. 161.1.1.1: entretien préalable from the 4th jour ouvrable counted from the day after the first presentation of the convocation, then notification by registered letter from the 4th to the 30th jour ouvrable counted from the day after the entretien). The Code du travail reaches this sector only through the closed list of art. L.7221-2, which does not include the L.1232-2 procedure.
