What an assistant maternel is paid
The hourly minimum per child, how the monthly salary is built, and what is an allowance rather than pay. Figures in force since 01/06/2026, each with its article.

The hourly minimum, per child
An assistant maternel is paid per child and per hour of reception. Two floors apply at the same time and the employer owes the higher of the two:

From the hourly rate to the monthly salary
The pay of a regular reception is averaged over 12 months, so the same amount is paid every month whatever the weeks of reception (CCN art. 108.1). Which formula applies depends on the care mode written in the contract (art. 97):

In an année incomplète the weeks without reception are written in the contract, or given in writing at least 2 months ahead (art. 98.1.2), and the paid leave is excluded from the averaged weeks (art. 97.1).
What is not salary
Two allowances sit next to the pay and follow their own rules. They carry no social contributions, and they are excluded from the base of the end-of-contract indemnity of art. 121.1 — a point that changes the amount due when a contract ends.

Declaring the month
The employer declares each month on Pajemploi: the hours of reception and the gross pay of the month, plus the allowances. The declaration opens on the 25th of the month worked and is due by the 5th of the next month. Pajemploi computes the net and the contributions.
Both parties see the same hours and the same gross on AdminLanding: the assistant maternel records the month, the family confirms it, and a difference is flagged before the declaration rather than after it.

Which procedure applies: for a particulier employeur, the dismissal procedure of the convention collective IDCC 3239 applies instead of the Code du travail procedure (CCN art. 161.1.1: the rules are those of the convention; art. 161.1.1.1: entretien préalable from the 4th jour ouvrable counted from the day after the first presentation of the convocation, then notification by registered letter from the 4th to the 30th jour ouvrable counted from the day after the entretien). The Code du travail reaches this sector only through the closed list of art. L.7221-2, which does not include the L.1232-2 procedure.
